PEACE AGREEMENT BETWEEN THE NATIONAL GOVERNMENT AND THE
REINCORPORATED PERSONS FROM THE CACIQUE NUTIBARA BLOCK OF
THE UNITED SELF-DEFENSE FORCES OF COLOMBIA - AUC
La Ceja, Antioquia, 16 December 2003
The national government, represented by the High Commissioner
for Peace, Dr. Luis Carlos Restrepo, and the members of
the Cacique Nutibara Block, represented by Jovani de Jesús
Marín Zapata and Fabio Orlando Acevedo Monsalve,
in fulfillment of what was established on 15 July 2003 in
the Santa Fe de Ralito framework agreement and supported
by Resolution 216 of 24 2003, have agreed to the following
points:
- The process of reincorporation into civilian
life of the demobilized persons begins on 16 December 2003,
and will be extended over the period of a year and a half
until 16 July 2005, at which time the program of re-incorporation
for these beneficiaries will have ended. Once this reincorporation
period has ended, the parties involved may agree upon other
programs to be carried out during the reconciliation phase.
- The political responsibility for the reincorporation is
within the competence of the national government. The Office
of the Mayor of Medellín will contribute in developing
programs for reincorporation and especially in developing
a model for verification, monitoring, and follow-up The
national government recognizes the Non Governmental Organization
named the "Corporación Democracia" (Democracy
Corporation) as the organization representing the reincorporated
persons of the Cacique Nutibara Block and will maintain
a permanent dialogue with this organization for follow-up,
development, and support for the reinsertion process. The
national government, the Office of the Mayor of Medellín,
and the Corporación Democracia will design the programs
for follow-up, development, and support for the reinsertion
process.
- In the same manner, the national government and the Office
of the Mayor of Medellín will support, when they
consider it appropriate, the development of initiatives
for peace, coexistence and reconciliation carried out by
this Non Governmental Organization.
- The benefits for the demobilized persons of the Cacique
Nutibara Block, including the legal ones, have been placed
within the framework of Law 782 of 2002 and Decree 3360
of 21 November 2003, as well as Resolution 217 of 24 November
2003.
- With respect to employment, the current
Office of the Mayor of Medellín will place those
who fulfill the requirements in employment alternatives
for a period of at least one year, at the end of which the
Office of the Mayor, in accordance with the budgetary reality
of the municipality of Medellín, will evaluate each
person's situation on order to extend those contracts that
it considers convenient or seek other employment options
in the public sector, the private sector or in developing
individual or collective projects for creating businesses.
Likewise, the national government will seek employment options
with the private sector.
- The national government will provide whatever is appropriate
to guarantee affiliation with the SISBEN for the demobilized
persons, whenever it is appropriate within the legal framework.
- The national government will provide security for the
reincorporated persons as a whole, as well as security for
six of its leading members and the organization's spokesperson.
The municipality of Medellín and Metro Seguridad
(Metropolitan Security) will contribute towards the design
of programs and logistical support in order to achieve this
goal. Metro Seguridad, of the Office of the Mayor of Medellín,
will logistically support the functioning and equipping
of the preventive information network that will have to
be created in order to provide for early warnings that are
to protect the demobilized persons and their sectors for
return and settlement.
- The municipality of Medellín will contribute by
means of the program for follow-up, monitoring and psychosocial
accompaniment for both individual and collective cases,
which will be the responsibility of the High Commissioner's
Office for Peace. To this end, the municipal administration
will be responsible for creating zonal centers for attention
for the reincorporated persons. New people or organizations,
with respect to which there is no doubt of their neutrality
and seriousness, can be invited to participate in the follow-up,
and the purpose and objective of their inclusion will have
to be defined and made clear to them. The program for follow-up,
monitoring and accompaniment will have to be regulated before
the end of January 2004.
- Verification of the process and of the agreements will
be the responsibility of the Verification Commission, agreed
upon between the parties involved and designated by the
national government by means of Resolution 216 of 24 November
2003. Verification can be extended upon mutual consent of
the parties involved.
- The reincorporated persons, by means of an individual
agreement of commitment to the peace of Colombia, provide
proof of their decision to abandon their illegal status
and give up their arms and organization, and commit themselves
to not join an illegal armed group again. Whoever fails
to fulfill this, will lose all of the benefits derived from
this peace process.
- The institutions of the State recognize and respect the
civil, political and legal rights of the reincorporated
persons as citizens of Colombia.
- The reincorporated persons, and especially their leaders,
commit themselves to collaborate with the legitimately constituted
authorities, working within the framework of legality and
cooperation that applies to all citizens.
- The reincorporated persons will have an internal identification
document for administrative purposes, which is to be guaranteed
by the Office of the High Commissioner for Peace.
- Starting from the moment in which they surrender their
arms, the reincorporated persons commit themselves to cease
all hostile, violent and armed actions. They also commit
themselves as new citizens living in a legal manner to abandon
any illegal source of financing.
